Civil Liberty
The issue in New Jersey V TLO is over civil liberties. Civil liberties are natural freedoms protected from government action. The issue discussed in this case revolves around unreasonable searches and what constitutes a reasonable search. The right of the people to not have any unreasonable searches is outlined in the fourth amendment. This particular case deals with civil liberties and not civil rights because everyone has a right to their privacy until it is reasonable to infringe upon it. Therefore, this case deals with protecting people, specifically students, from the government on the grounds of unreasonable searches. More specifically, in a school setting the court upheld that school officials must provide students with privacy until they have reasonable suspicion to search them, or their belongings.
